This class action lawsuit was brought against Palm involving the m100, m105 and m125 handhelds. The lawsuit stated the PDAs may be defective in that they sometimes lose data during the process of replacing batteries even when the user follows Palm's recommended procedure.

#2. Look at my sig. How many $ is *THAT* in Palm's pocket. That doesn't count accessory or software purchases, either. I don't have any of those old dinosaurs laying around anymore anyway. I have never lost data due to "not following instructions". However, I have been on a 2-week trip in the middle of nowhere and have my T|T2/3 digitizer fail on me, rendering my productivity almost non-existant at that time. Looking at all the B.S. lawsuits Palm has fought over the years it's easy to understand why they overcharge for their hardware. All those sheep who paid Palm full price for Vx, T5, LifeDrive, etc. have helped subsidize this nonsense that keeps sleazy lawyers employed.
Microsoft, RIM, Palm, etc. spend hundreds of millions fighting (and often losing) bogus lawsuits each year. Lawsuits have now become an EXPECTED business expense, much like healthcare for employees. Pathetic. Funny how I don't see too many Chinese companies getting sued. Maybe it's a wise idea to avoid selling products or or basing a business in the USA (especially here in wacky California!) alltogether? I.M. Well the cost of employee relations and welfare are very much reduced for Chinese companies - aside from cheaper wages trade unions are banned by the communist government. Even China allows lawyers but I don't see many lawsuits being successful against companies there, seeing how the Chinese government has a major influence in almost every major enterprise there! Call me cynical but maybe this is one of the benefits of Western companies moving production to China, no pesky unions to get in the way of production and profits! RE: Poor Palm. Actually, Palm wouldn't be getting sued unless some people felt that Palm had caused them problems. Their quality is poor, their customer service is virtually non-existent, and they have always had a habit of overcharging for units that have sub-par specs. I don't think people should send in the m-series pda unless they have a VALID claim, but on the other hand, the animosity towards Palm is not entirely unwarranted either.

In any event, this suit was supposedly settled back in May 2005, and I have yet to hear of anyone getting anything out of it. Has ANYONE gotten a defective m1xx replaced? RE: You do realize, of course...

Back in may the settlement terms were proposed. The news here is that Palm & the courts accepted them and now Palm has to get to work on the claims.

I got a couple of emails from people who misunderstood my satire of the initial remark, and just want to say I'm sorry if I gave offense, even unintentionally. As I said in a relevant post which was deleted amongst all that Canada bashing, this settlement has authority only within the USA. I sympathize with your predicament hoodo but it's up to Canadians to carry out their own legal action against Palm within Canada as appropriate. If people in all the countries Palm sells its handhelds were to take similar action then Palm will be less likely to foist such defective handhelds onto the market. Arguably, competition from Windows Mobile and Symbian devices should be enough inducement for Palm to maintain a high level of quality control for its devices. RE: You do realize, of course...

David; I really don't have a HUGE list of demands from my Palm and the things it cannot do cannot be resolved by posting my questions in the PIC or BH forums for more experienced users. It's just a limitation of the OS/hardware/carriers (why no "real" G1 option that's reliable? Why no BT DUN on CDMA carriers). So, like Gekko, since my PDA does all I need/want it to do as far as PIM/photo-viewing "basics" are concerned, I see PIC now as more of an entertainment/conversational/debate forum that I enjoy participating in over a "n00b" info resource as I viewed it in '99 or '00. And, keeping that point in mind, the Voice DOES provide entertainment in SPADES. I mean, some peoople prefer avant-garde french cinema. Others prefer the Farrelly brothers' comedies as a sort of comedic, escapist fun. Make sense? Take everything you read & post here with a grain of salt. Skippy is just some 30 year old living in its parents' basement, substituting the intarweb for the real world.
It has a great deal of low cunning, a crude juvenile sense of humor, and a huge need for attention. It is also mildly good at doing a cold reading, which is how it achieves most of what appears to be its 'inside' information. No doubt Skippy is a fan of R Crumb and Mad magazine, which would go a long way towards explaining both its sense of humor and its outlook on life. It wouldn't surprise me at all if Skippy spent most of its money on attending cosplay conventions. Matt Groening probably based the comic book guy on Skippy.

I'd stick to pushing the "ACCESS as hostage-taker" scenario if I were you. At the very least, since ACCESS isn't going to be selling PalmSource to Palm, you should be able to run with that one for a while without being immediately shown to be wrong. Actually, I like my Access-as-a-better-Symbian theory the best: Great OS + huge app library + good developer community + fair developer tools; without overbearing spectre of Nokia trying to run the show = instant mobile platform IF packaged with ALL the ingredients (as I've previously suggested that PalmSource have rolled into PalmOS). If folks can bear a small digression, there are some distinctions to be noted between Cobalt and Copland. I worked on both, and I take strong exception to the description of the former as "a steaming pile of feces".
Foremost among the differences between these two projects is that Cobalt GM'd, twice, 6.0 and 6.1. I worked on both releases, and I use a device running Cobalt as my main handheldâand no, I won't tell you which off-the-shelf PDA I reflashed to enable that, I'm just fortunate that wayâand it's a very good operating system, with some significant advantages over "stock" Linux on that type of device and some neat innovations. The reasons it didn't get into the marketplace are complex, and I'm not going to get into 'em, but it was certainly not because it was a project that never finished (as was Copland) or that it was simply "crappy." This isn't exactly the impression I got from your former hardware division, nor from your own people. As far as its being "half an operating system," we worked closely with several licensees on devices that--while they haven't made it to market, again for a variety of reasons that I'm not in a position to discuss--were for all practical purposes ready to go. Oswin demoed their version at the developers' conference last year, and there were several other efforts. Again, I'm not in a position to go into specifics, but I can say that none of 'em had to do with failures or lacks on the part of the software.
Getting driver support, something we'd hoped we wouldn't wind up being solely responsible for, was indeed one of the issues which proved to be problematical, as was learning curve in general; this was one of major factors in making a move to Linux attractive. For the record, Cobalt incorporated full file system support from its initial release, as well as including a NAND-optimized version of the LFS file system in v6.1. The stuff I've heard from Palm, and from PSRC on the occasion of the Cobalt 6.1 release, was that the reason Cobalt never made it was because it was effectively half an operating system.
I can't imagine anyone who knew their stuff making that statement. Whatever Cobalt's problems were or are, it was complete.

But I have had it from PalmSource people that the 6.0 release of Cobalt was not in the condition it should have been for a released product, which was one of the reasons for going back and doing the revisions that were done in 2004.

Ah yes, Nagel was quite the teller of tall tales. My personal favorite was his long running (ultimately unsubstantiated) claim that PalmSource was sitting on top of 29+ new licensees. All lies of course, but in hindsight it's rather fitting that a vaporware OS should have vaporware licensees as well.

Cobalt's over with, and no one will ever know the whole story. Lefty had very little to do with it -- he was just running a driver writing team at the time, I'm told, and Skippy is just guessing (poorly as usual) about what happened. Besides, Nagel et all are gone from PalmSource, and it's under new management. You should probably both get over it and move on to whining at each other about cobalt on linux or whatever Access is going to call it. And if you're going to throw amateur insults at each other, take it to alt.flames, you're both getting pretty boring.

I submitted my Claim to Palm for my m-Series Palm in October '05. I have yet to receive any response or Return Authorization form from them. Has anyone else been stiffed by Palm on this? I guess I must be dumb but I thought I was supposed to send the form and the palm by February or I would be out of luck. So I packaged it all up and sent it, form and Palm together. I have the USPS receipt and everything. I was wondering what was going on but it seemed there was no one to really contact until Palm sends me a support request saying essentially they got the form and set up a repair request and now I am supposed to send the Palm.
Well, considering I sent it to Taylor Settlement Is anyone else by chance in the same boat???? Anyone know how to contact the Grand Rapids office?
