Comments on: Final Settlement in Defective m Series Suit

Final judgement regarding the Taylor vs. Palm suit has been reached and accepted. This class action lawsuit was brought against Palm involving the m100, m105 and m125 handhelds. The lawsuit stated the PDAs may be defective in that they sometimes lose data during the process of replacing batteries even when the user follows Palm's recommended procedure.

#2. Look at my sig. How many $ is *THAT* in Palm's pocket. That doesn't count accessory or software purchases, either.
BTW, I went through 3 (three) T3's in less than two years' time. I think we can be safely assured that Palm's (lack of) quality speaks volumes.

I don't have any of those old dinosaurs laying around anymore anyway. I have never lost data due to "not following instructions". However, I have been on a 2-week trip in the middle of nowhere and have my T|T2/3 digitizer fail on me, rendering my productivity almost non-existant at that time. It's time Palm is finally held accountable for their inconsistent build quality and slap hazard attention to detail.

Looking at all the B.S. lawsuits Palm has fought over the years it's easy to understand why they overcharge for their hardware. All those sheep who paid Palm full price for Vx, T5, LifeDrive, etc. have helped subsidize this nonsense that keeps sleazy lawyers employed.

Microsoft, RIM, Palm, etc. spend hundreds of millions fighting (and often losing) bogus lawsuits each year. Lawsuits have now become an EXPECTED business expense, much like healthcare for employees. Pathetic. Funny how I don't see too many Chinese companies getting sued. Maybe it's a wise idea to avoid selling products or or basing a business in the USA (especially here in wacky California!) alltogether?

Well the cost of employee relations and welfare are very much reduced for Chinese companies - aside from cheaper wages trade unions are banned by the communist government. Even China allows lawyers but I don't see many lawsuits being successful against companies there, seeing how the Chinese government has a major influence in almost every major enterprise there!

Call me cynical but maybe this is one of the benefits of Western companies moving production to China, no pesky unions to get in the way of production and profits!

Actually, Palm wouldn't be getting sued unless some people felt that Palm had caused them problems. Their quality is poor, their customer service is virtually non-existent, and they have always had a habit of overcharging for units that have sub-par specs. I don't think people should send in the m-series pda unless they have a VALID claim, but on the other hand, the animosity towards Palm is not entirely unwarranted either.

In any event, this suit was supposedly settled back in May 2005, and I have yet to hear of anyone getting anything out of it. Has ANYONE gotten a defective m1xx replaced?

Back in may the settlement terms were proposed. The news here is that Palm & the courts accepted them and now Palm has to get to work on the claims.

As I said in a relevant post which was deleted amongst all that Canada bashing, this settlement has authority only within the USA. I sympathize with your predicament hoodo but it's up to Canadians to carry out their own legal action against Palm within Canada as appropriate. If people in all the countries Palm sells its handhelds were to take similar action then Palm will be less likely to foist such defective handhelds onto the market.

Arguably, competition from Windows Mobile and Symbian devices should be enough inducement for Palm to maintain a high level of quality control for its devices.

At any rate, such a combination of hilarious dry wit (all of it is tongue in cheek-haven't you realized this by now), erudite technical knowledge of the mobile industry, and "edumacated" common sense business acumen make Voice the most entertaining and enlightening poster on PIC. If he/she/it stuck to their guns and left PIC for good I'd probably find myself posting less (at least on the front page) due to a lack of good debate being stirred up. I am not taking sides here, just expressing my view.

On the same note, I appreciate Marty's as honest as possible "front lines" reports and David Beers' always professional replies and comments. And, yes, Gekko's little quips are entertaining too and his attitude "I don't have time to mess with what doesn't work" most closely reflects my own stance and those that I work with on a daily basis (ie the non-technie gearhead). Dr. O is the only poster here that I feel brings NOTHING to the table from a humor, technical, or intelligent debate standpoint.

The point I'm trying to make here is that everyone needs to keep in mind this is JUST a mobile technology news site/forum and settle down. We all have our pluses & minuses and contribute to the "personality" that is PIC. If it means overlooking the clatter at times then so be it.

He supposedly runs the "help desk" at a hospital. I think that's what they call the therapy he's receiving there. Judging the results by what he posts here I think upping his Respridol dosage would be a better way to go.

I am anything but naive. I really see PIC as about 60% entertainment/40% PDA news at this stage in the game.

I really don't have a HUGE list of demands from my Palm and the things it cannot do cannot be resolved by posting my questions in the PIC or BH forums for more experienced users. It's just a limitation of the OS/hardware/carriers (why no "real" G1 option that's reliable? Why no BT DUN on CDMA carriers).

So, like Gekko, since my PDA does all I need/want it to do as far as PIM/photo-viewing "basics" are concerned, I see PIC now as more of an entertainment/conversational/debate forum that I enjoy participating in over a "n00b" info resource as I viewed it in '99 or '00. And, keeping that point in mind, the Voice DOES provide entertainment in SPADES. I mean, some peoople prefer avant-garde french cinema. Others prefer the Farrelly brothers' comedies as a sort of comedic, escapist fun. Make sense? Take everything you read & post here with a grain of salt.

But remember, to a layman such as myself, when the Voice starts posting bits about CodeWarrior & MetroWorks & SuperWaba, he apppears to have SOME knowledge of the developmental side of the business, no? It has a great deal of low cunning, a crude juvenile sense of humor, and a huge need for attention. It is also mildly good at doing a cold reading, which is how it achieves most of what appears to be its 'inside' information.

No doubt Skippy is a fan of R Crumb and Mad magazine, which would go a long way towards explaining both its sense of humor and its outlook on life.

It wouldn't surprise me at all if Skippy spent most of its money on attending cosplay conventions.

It wouldn't take a lot of effort to make PalmOS into a killer mobile platform. PalmSource was too clueless to see this. A better-run company might have better luck.

I simply worked on networking issues related to it at the time as an individual contributor/tech lead, along with a number of others—this was at least two years prior to my taking over management of the Mac OS 9 Networking team.

A Couple of Words on Cobalt and Copland...

If folks can bear a small digression, there are some distinctions to be noted between Cobalt and Copland. I worked on both, and I take strong exception to the description of the former as "a steaming pile of feces".

Foremost among the differences between these two projects is that Cobalt GM'd, twice, 6.0 and 6.1. I worked on both releases, and I use a device running Cobalt as my main handheld—and no, I won't tell you which off-the-shelf PDA I reflashed to enable that, I'm just fortunate that way—and it's a very good operating system, with some significant advantages over "stock" Linux on that type of device and some neat innovations.

The reasons it didn't get into the marketplace are complex, and I'm not going to get into 'em, but it was certainly not because it was a project that never finished (as was Copland) or that it was simply "crappy."

Just thought you should know.

Wish I could find that old briefing PowerPoint they sent us for the Cobalt 6.1 release. Besides C6.1, it also talks about the 11 Palm OS smartphones to be released in the first quarter of 2005. I can find my other briefing packets, but not the one from Palm for that day. Dang.

Ah yes, Nagel was quite the teller of tall tales. My personal favorite was his long running (ultimately unsubstantiated) claim that PalmSource was sitting on top of 29+ new licensees. - Instability
- Sluggish performance
- Heavy hardware requirements (minimun 400 - 500 MHz CPU)
- Wonky multithreading/problematic memory allocation (crash and BURN, Baby! BURN!)
- Missing telephony (Sprint? Can you hear me? Can you HEAR ME!)
- Lack of drivers (an oft-quoted, "convenient" excuse)
- Lack of raison d'etre (no Cobalt-specific apps -> no need for Cobalt)
- PalmOS 5 (a known quantity) was hackable to near-Cobalt specs (Helloooooooo Tapwave!) without all the Cobalt headaches.
- Loss of confidence in PalmSource. Licensees realized they were being suckered by the old shell game and decided to cut their losses when the delays/excuses started
- Freakish new coding skillset required for Cobalt-specific apps + no serious commercial app coding environment available
- Lack of true multitasking - oops! (You mean multithreading isn't "almost as good"???)
- It was too little too late to compete with the upcoming Windows Mobile 5

and...
- It smelled of Be engineers (the smell of death)

Lefty had very little to do with it -- he was just running a driver writing team at the time, I'm told, and Skippy is just guessing (poorly as usual) about what happened. Besides, Nagel et all are gone from PalmSource, and it's under new management.

You should probably both get over it and move on to whining at each other about cobalt on linux or whatever Access is going to call it.

And if you're going to throw amateur insults at each other, take it to alt.flames, you're both getting pretty boring.

I am writing to update you regarding the settlement proceedings. As you know, this litigation was brought in connection with data loss in Palm m100 series PDA's (upon battery replacement). The case was settled successfully on November 18, 2006. The settlement allows owners of defective PDAs to receive a replacement unit (refurbished or new, depending on Palm's inventory) of equal or greater value. We beleive this is a fantastic recovery that has real value. To receive a replacement unit, claimants must use the "Final Claim Form" found on the taylorsettlement.com web site. The deadline was originally in February 2006. The NEW deadline is July 16, 2006. All claim forms are to be sent to:

P.O. BOX 1120
Grand Rapids, MN 55745-1120

Please note, claim forms should NOT be sent to our office. Palm, Inc. is administrating claims out of Minnesota, and this Minnesota office must receive the claim forms!!!

I understand that many claimants sent in their claim form months ago. Please do not feel as though you have been forgotten. A national claims process takes some time to get up and running. Palm assures us they are working hard to prepare the administration of claims, and that claimants who have submitted a claim form will soon be contacted.

At this point in time, our office has not been made aware of which claim forms have been received by Palm. I apologize, but we are unable to investigate on your behalf. My only suggestion to those who are concerned their paperwork was lost is to send a second claim form (a copy) via certified mail with a note explaining its purpose.

Am I the only idiot that sent my Palm with the form ???

I guess I must be dumb but I thought I was supposed to send the form and the palm by February or I would be out of luck. So I packaged it all up and sent it, form and Palm together. I have the USPS receipt and everything. I was wondering what was going on but it seemed there was no one to really contact until Palm sends me a support request saying essentially they got the form and set up a repair request and now I am supposed to send the Palm.

Well, considering I sent it to Taylor Settlement
P.O. Box 1120 Grand Rapids, MN 55745-1120, 4 months ago, thats going to be tough. Obviously, the got the form and I have emailed customer service twice about where the Palm could be and they just don't respond.

Is anyone else by chance in the same boat???? Anyone know how to contact the Grand Rapids office?
